Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and MovieMixTape, Inc. ("Company," "we," "us," "our," or "MovieMixTape"). By accessing and using our website (www.moviemixtape.com), mobile applications, and streaming services, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our services. We reserve the right to modify these Terms at any time, and your continued use of MovieMixTape constitutes acceptance of any changes.

Subscription and Billing

MovieMixTape offers various subscription plans with different features and pricing. By subscribing, you agree to:

• •Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date
• •Payment Authorization: You authorize us to charge your payment method for the subscription fee and any applicable taxes
• •Billing Information: You agree to provide accurate, current, and complete billing information and notify us of any changes
• •Price Changes: We may change subscription prices with 30 days' notice. Continued use after the notice period constitutes acceptance
• •Cancellation: You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle
• •No Refunds: Subscription fees are non-refundable except as required by law. Partial month fees are not prorated

Use License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use MovieMixTape for personal, non-commercial purposes. This license is subject to the following restrictions:

• •No Reproduction: You may not reproduce, duplicate, copy, sell, or resell any portion of our services or content
• •No Scraping: You may not use automated tools, bots, scrapers, or any technology to extract, collect, or harvest data from MovieMixTape
• •No Circumvention: You may not attempt to bypass, disable, or circumvent any security measures, DRM, or access controls
• •No Unauthorized Access: You may not attempt to gain unauthorized access to our systems, networks, or databases
• •No Malicious Activity: You may not transmit viruses, malware, ransomware, or any code of destructive nature
• •No Interference: You may not engage in any conduct that restricts or inhibits anyone's use or enjoyment of MovieMixTape
• •No Illegal Use: You may not use our services for any illegal, fraudulent, or unauthorized purpose

Account Responsibility

When you create a MovieMixTape account, you are responsible for:

• •Accurate Information: Providing accurate, current, and complete information during registration and keeping it updated
• •Password Security: Maintaining the confidentiality of your password and account credentials and not sharing them with others
• •Account Activity: Accepting responsibility for all activities that occur under your account, including unauthorized access
• •Notification: Notifying us immediately of any unauthorized use of your account or security breach
• •Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account
• •One Account Per Person: You may not create multiple accounts or share your account with others outside your household

Simultaneous Streaming Limits

Your subscription plan includes a specific number of simultaneous streams. Standard plans allow 2 simultaneous streams, Premium plans allow 4 simultaneous streams. Exceeding your plan's limit may result in service interruption. We reserve the right to enforce these limits and may terminate accounts that consistently violate streaming limits or share credentials outside their household.

Content and Intellectual Property

All content available on MovieMixTape, including movies, TV shows, images, text, graphics, logos, and software, is the property of MovieMixTape or its content providers and is protected by international copyright, trademark, and intellectual property laws. You agree not to:

• •Download, record, or distribute any content without proper authorization
• •Circumvent digital rights management (DRM) or copy protection measures
• •Use content for commercial purposes without explicit written permission
• •Remove, alter, or obscure any copyright, trademark, or proprietary notices
• •Stream content to public audiences or in commercial settings

User-Generated Content

If you submit, post, or display content on MovieMixTape (such as reviews, comments, ratings, or watchlist items), you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, distribute, and display such content. You represent and warrant that:

• •You own or have the necessary rights to the content you submit
• •Your content does not violate any third-party intellectual property rights
• •Your content is not defamatory, obscene, hateful, or otherwise unlawful
• •Your content does not contain personal information of others without consent

We reserve the right to remove any user-generated content that violates these Terms or our community guidelines.

Prohibited Content and Conduct

You agree not to use MovieMixTape to:

• •Harass, threaten, defame, or abuse other users
• •Post spam, advertisements, or promotional content
• •Engage in phishing, fraud, or deceptive practices
• •Violate any applicable laws or regulations
• •Infringe on intellectual property rights of others

Disclaimer of Warranties

MovieMixTape is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, expressed or implied. We make no warranties regarding the service, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or title. We do not warrant that our services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content on our platform.

Limitation of Liability

To the fullest extent permitted by law, MovieMixTape shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, business interruption, or loss of use, arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless MovieMixTape and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from your use of our services, violation of these Terms, infringement of any third-party rights, or any illegal or unauthorized activity.

Termination

We reserve the right to terminate or suspend your account and access to our services at any time, with or without cause, and with or without notice. Reasons for termination may include:

Any dispute arising from these Terms shall be resolved through binding arbitration rather than court proceedings, except for claims of intellectual property infringement or injunctive relief.
